PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 December 1999, Orders 355-0010, DA, HQ, 101
st Airborne Division (Air Assault) and Fort Campbell, KY. Discharged the applicant from the Regular Army, effective date: 000105. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 5, AR 635-200, by reason of personality disorder with a characterization of service of honorable. The specific facts and circumstances leading to the applicant’s discharged are not contained in the available records.

         b. On 5 January 2000, the applicant was discharged. At the time of discharge, the applicant had 10 months, and 11 days, service on his current enlistment under review and 5 years, 2 months and 10 days, total time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2), (3), (9), (10), (11), (15), (22), and (23) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant showing that he was honorably discharged for a personality disorder. The available evidence of record does not support the applicant’s contention that he did not have a personality disorder and the applicant has provided no independent corroborating evidence showing he does not have a personality disorder. In the absence of evidence to the contrary, the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge was proper and equitable, voted not to change it.

(1), (4), (5), (7), and (12) The issues are rejected. The applicant’s issues regarding his physical disabilities at the time of his discharge and Veterans Administration benefits are not within the purview of the Army Discharge Review Board.

(6), (17), (18), (19), and (21) The issues are rejected. These matters are not issues on which the Army Discharge Review Board grants a change in narrative reason because they raise no matter of fact, law, procedure, or discretion relating to the discharge process nor are they associated with the discharge at the time of issuance.

(8) and (20) The issues are rejected. The applicant has provided no independent evidence to support his contention that marital problems contributed to his discharge for a personality disorder.

(13), (14), (15), and (16) The issues are rejected. In the absence of evidence to the contrary, the Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.
